Julie A. Su sues Green Maintenance Services Inc. for labor law violations

In the United States District Court, Northern District of Illinois, Eastern Division, Julie A. Su, Acting Secretary of Labor for the United States Department of Labor, has filed a lawsuit against Green Maintenance Services Inc., an Illinois corporation, and Jan Jarosz, an individual. The case is identified as 1:24-cv-03094 and was filed on April 17th, 2024.

The plaintiff alleges that the defendants violated Sections 206, 207, 211, 215(a)(2), and 215(a)(5) of the Fair Labor Standards Act (FLSA). The Wage and Hour Division conducted an investigation into the defendants' employment and pay practices from April 7th, 2021 through April 6th, 2023. Two sanitation workers were misclassified as independent contractors when they were economically dependent upon Green Maintenance Services Inc., leading to violations of labor laws.

The plaintiff seeks to enjoin and restrain the defendants from further violations of the FLSA. Additionally, they are seeking to recover unpaid compensation plus an equal amount in liquidated damages pursuant to Section 216(c) of the Act for the defendants’ employees.
