A Berwyn police officer is suing over claims he was injured by bullet fragments when another officer shot a dog.
Sergio Diaz filed a lawsuit Sept. 2 in Cook County Circuit Court against Fernando Trevino, also known as Fernando Frevino or Fernando Oviedo, and Norma Agueta, alleging violations of the Illinois Animal Control Act.
According to the complaint, Diaz, in his capacity as a police officer, responded to the report of a dog attack on Sept. 13, 2012 on South Ridgeland Avenue in Berwyn, where the defendants kept two dogs.
Diaz claims one of the pit bulls escaped the yard and was running freely, causing another officer reporting to the incident to shoot and kill the dog Diaz, the suit states, was struck with bullet fragments in his lower limbs.
Diaz is seeking more than $50,000 in damages and is represented by attorney Matthias D. Gill of Hoey & Farina in Chicago.
