Man sues over workplace milk injuries

A man is suing a milk company and its driver after suffering injuries when a pallet of milk fell on him at work.

Bradford Tepper filed a complaint May 29 in Cook County Circuit Court against Joseph McMahon Dairy Service Inc., doing business as McMahon Dairy Service, of Huntley, and an unknown driver.

On March 15, 2014, the unknown driver drove a McMahon truck into the Dean Foods' dairy supply facility at 11713 Mill St., in Huntley, where Tepper was working.

When the McMahon driver used a pallet jack to load a pallet of hundreds of gallons of milk onto his truck, he asked Tepper to help with the loading, the lawsuit states. After Tepper began to help, the lawsuit states, the driver "caused the pallet of milk to become unstable and the load fell onto" Tepper.

The defendants are cited with failing to properly position the truck in the loading dock, use the proper ramp, ensure the truck bed was aligned with the dock, properly secure the load on the pallet jack, and properly position the loading dock ramp on the truck so the load could be safely loaded.

As a result, the lawsuit states, Tepper suffered injuries, pain and suffering, medical expenses and loss of a normal life and earning capacity.

The plaintiff, citing negligence, seeks damages in excess of $100,000, plus costs. The plaintiff is represented by attorneys David A. Williams and Brad J. Balke of Chicago.
