Shopper blames grocery for slippery floor accident

A Cook County woman has sued a grocery retailer, alleging negligence in a 2013 accident.

Linda Kogen filed a lawsuit May 8 in Cook County Circuit Court against New Albertson’s Inc., doing business as Jewel-Osco Inc., alleging premises negligence in a 2013 incident.

According to the complaint, on May 12, 2013, Kogen was on the store premises, at 4355 N. Sheridan Road in Chicago, when she slipped and fell in one of the aisles due to a slippery floor condition. The suit states Jewel-Osco was negligent in its failure to maintain the aisle in a reasonably safe condition, instruct staff to properly maintain the area, warn patrons of the condition, and provide a safe shopping environment for customers.

The suit says Jewel-Osco allowed an unnatural accumulation of water or moisture to collect on its floors and should have known that it was present.

The complaint states the plaintiff was damaged and incapacitated, citing: medical, dental, surgical or hospital care expenses; lost wages; plus pain, disability and disfigurement.

Kogen seeks actual damages in excess of $50,000, plus attorney fees and costs. She is represented by Fonzetti Legal Services in Chicago.
