Delivery worker cites state business for injuries in hydraulic door failure

A Cook County man has sued a state corporation, alleging negligence in an April accident.

Justin Duprey filed a lawsuit June 3 in Cook County Circuit Court against Burnham Center, a state corporation, at 111 West Washington St., Chicago regarding an April accident.

According to the complaint, on April 10, Duprey, employed as a messenger for Royal Expediting Inc. of Addison, was assigned to deliver piping equipment to Burnham Center. When the plaintiff accompanied an electrician to carry the pipes into the building at 111 West Washington, the electrician pressed a red button activating a heavy metal door to rise up by hydraulic pressure, the suit says.

The filing states when Duprey walked under the door, it came down suddenly onto his head and he fell to the ground bleeding, and then fainted. The suit states Burnham Center was in breach of duty by: failing to provide safe ingress and egress of passageway for persons on the premises; to inspect and maintain the door in a safe condition and in accordance with code.

The plaintiff alleges permanent physical injuries, pain and suffering, disfigurement, disability, medical expenses and loss of a normal life.

Duprey seeks actual damages in excess of $50,000, attorney fees and costs. He is represented by attorney Michael Cogan of Cogan & Power in Chicago.
