Supplier seeks payment for materials provided in CTA project

A materials supplier has sued to recover payment on materials it allegedly supplied for a transit authority project.

Seasons-4 filed a lawsuit June 2 in Cook County Circuit Court against the Chicago Transit Authority, Edwards Engineering Inc., W.E. Bishop and Co., and Western Surety Co, citing breach of contract.

According to the complaint, on June 18, 2014, Bishop and Seasons-4 entered into a purchase order for various subcontracted materials for a project being handled at the 103rd bus garage at 10201 S. Stony Island Ave., Chicago, by the rest of the defendants. The suit says on Dec 12, 2014, Bishop received the materials, and on Dec. 30, 2014, Seasons-4 sent Bishop an invoice for payment, amounting to $1,942,550. No payment has been made, the lawsuit states.

On Feb. 9, CTA terminated Edwards from its construction contract, and Seasons-4 served CTA, Edwards, Biship and Western Surety a notice of claim, the suit says.

Seasons-4 seeks payment of its invoice, prejudgment interest, attorney fees and court costs. It is is represented by attorney Matthew M. Kovalcik of Parker, Ibrahim & Berg in Chicago.
