Estate sues over fatal vehicle accident

A man's estate is suing the driver allegedly responsible for the accident that caused the man's death.

Joyce Schmit, administrator of the estate of Robert Schmit, filed a complaint June 5 in Cook County Circuit Court against Timothy J. Coutee.

On April 22, 2015, Robert Schmit was driving at Army Trail Road and Wall Street in Bloomingdale, while Coutee was driving near the same intersection. The lawsuit states that Coutee then collided with Schmit's vehicle. Authorities determined that Coutee was at fault.

The defendant is cited with failing to drive safely, stop before the collision, driving at a safe speed, keep a proper lookout, keep his vehicle under control, reduce speed or change direction, and yield the right of way.

As a result, the lawsuit states, the plaintiff suffered many injuries that led to his death.

The plaintiff seeks damages in excess of $100,000, plus costs.

The plaintiff is represented by the Law Office of David J. Heyer Ltd. in Chicago.
