Woman with broken back alleges negligence in pool accident

A Cook County woman is suing a property owner, alleging serious injuries in a swimming pool accident.

Lindsay Brown filed a suit June 19 in Cook County Circuit Court against Brian Hickey and Joseph Giannelli, respondent, alleging she was permanently injured by Hickey in a 2013 accident.

According to the filing, on July 13, 2013, Brown was a guest of the defendant in his 4-foot-deep, above-ground outdoor pool at his Cook County home. The suit says when Hickey picked up Brown and raised her over his head and she demanded that he put her down, he threw her downward with such force that she hit her back, head and neck on the pool bottom’s hard surface, breaking her back.

The suit states Hickey acted negligently, failed to consider the hazardous consequences and lowered her unsafely. The complaint says Brown suffered multiple spinal fractures and related injuries requiring extensive medical, surgical, therapeutic and pain management care and expenses.

The plaintiff maintains she has experienced and will continue to undergo pain and suffering, disabilities and impairments and the loss of enjoyment of her life as a result of the defendant’s actions. The plaintiff also requests discovery from Ginnaelli as a witness.

Brown seeks damages in excess of $100,000 plus attorney fees and costs. She is represented by attorney Thomas Nathan of Munday, Nathan & Schulkin in Chicago.
