Patient blames health facility for fall

Mullen associates

An Indiana woman and her husband are suing a health care facility and three of its physicians, alleging negligence in her medical care.

Deborah Jacko and William Jacko of Hammond, Ind., filed a lawsuit June 18 in Cook County Circuit Court against Alexian Brothers Behavioral Health Hospital in Cook County, Dr. Ginde Kumudini, Dr. Ambereen Ghani and Dr. Amina M. Rahim, alleging negligence. 

According to the complaint, from June 19-22, 2013, when Deborah Jacko was under the defendants’ care, she fell at least three times, sustaining a lacerated kidney, bruised eye socket, face and left hand. The suit says the defendants were in breach of professional duty to treat, observe and provide care for the plaintiff.

The lawsuit says the defendants failed to assess the patient for risk of falling, take precautions against her falling, provide appropriate devices or restraints and monitor the patient. The plaintiffs charge separate counts of negligence against each defendant, plus loss of consortium, love, care, affection and services.

The Jackos seek damages in excess of $100,000, plus attorney fees and costs. They are represented by attorney Lloyd Mullen of Mullen & Associates in Crown Point, Ind.
