Amy's Kitchen named in consumer fraud lawsuit

A man is suing Amy's Kitchen Inc. , which makes a variety of natural and organic convenient and frozen foods, for unlawfully labeling its packaging.

Corey Gilbert filed a class action lawsuit Oct. 21 in Cook County Circuit Court against Amy's Kitchen, alleging violations of the Illinois Consumer Fraud and Deceptive Practices Act.

The complaint claims that Amy's Kitchen caused injuries to Gilbert as a result of the unlawful sale of misbranded food products.

Gilbert alleges that Amy's Kitchen packaged and labeled its food products in violation of the Illinois Food, Drug and Cosmetic Act. He says that on Oct. 21, 2010, he purchased Amy's Kitchen's Asian Noodle Stir-Fry, Roasted Vegetable Lasagna and Baked Ziti Bowl all of which he contends contained an unlawful amount of evaporated cane juice.

Gilbert is seeking an order certifying this case as a state-wide class action, appropriate restitution, an order requiring the defendant to immediately cease and desist from selling the products noted in the suit and other monetary relief.

He is being represented in the case by attorneys at Malatesta Law Offices LLC.
