Insurance company sues contractors for negligence following house fire

Memberselesct Insurance Co., as subrogee of Ryan Gough, filed a lawsuit over a house fire Oct. 24 in the Cook County Circuit Court against Demarco Building and Restoration Inc., Eco Tec Insulation Inc. and Joseph Grimaldi, doing business as Brother Trim and Tile.

According to the suit, the company insured the Gough family's property at 4352 Prospect Ave. in Western Springs and the defendants were retained by the Goughs to remodel their home.

Part of the project involved an installation of a fireplace, chimney and spray insulation. Memberselect claims a fire occurred at the Gough house as a result of defects in the defendant's work, specifically the framing and insulation around the fireplace.

Memberselect, according to the suit, paid out $253,916.03 to the Goughs following the fire for damage.

The insurance company is accusing the defendants for breach of warranty and negligence and is seeking reimbursement of the money paid out to the Goughs. It is represented by attorney Brian T. Bailey.
