Whole Foods accused of wrongful termination by ex-employee

Dawn Pearson filed a wrongful termination lawsuit Nov. 6 in the Cook County Circuit Court against Whole Foods Market Group Inc.

Pearson claims she was improperly discharged by Whole Foods following a work-related accident at the Whole Foods in Northbrook, where she worked until her June 2010 firing.

She asserts she was fired for filing workers' compensation claims after she fractured her foot performing work-related duties. Predating this incident, the suit states Pearson missed work when she hurt her back in March 2009 and was out for eight months.

According to her complaint, Pearson went back to work in November 2009, but not at full-time status. She alleges that following her latest request for paid time off, Whole Foods decided to fire her, rejecting the legitimacy of her injury.

Pearson accuses Whole Foods of firing her maliciously, with gross indifference to her rights.

She is seeking more than $50,000 in damages. She is being represented by Chicago attorney Carey M. Stein.
