A child care facility is being sued over injuries an infant allegedly sustained after a fall.

Joseph and Laura Dudycha, individually and as parents and next friend of their minor child Brayden, filed a lawsuit Nov. 13 in the Cook County Circuit Court against Beth McPherson, citing negligence.

According to the complaint, McPherson was operating a child care facility at her home at 1108 E. Cooper Drive in Palatine on Dec. 5, 2011. The suit states McPherson was caring for Brayden, who was about 10 months old, when she secured him into a portable chair and placed him on a raised surface.

The Dudychas claim McPherson failed to provide a safe environment, ensure Brayden's safety and supervise Brayden. As a result of McPherson's alleged negligence, the suit states Brayden fell to the floor face down while constrained in the portable chair, causing his facial bones to be broken and multiple bruises and other injuries.

The plaintiffs are seeking damages in excess of $50,000. They are being represented in the case by attorney David T. Arena of DiMonte & Lizak LLC.
