Arris Group Inc. filed suit Nov. 18 in the Cook County Circuit Court against CyberPower Systems Inc.
The telecommunications equipment manufacturer is accusing CyberPower of breaching a supply contract dated June 1, 2007 after it allegedly provided defective products.
According to the suit, CyberPower agreed to supply Arris with battery backup units to incorporate into its fiber optic system telecommunications products, which were then sold to consumers.
Arris, which acquired Motorola Home last year from a subsidiary of Google, claims CyberPower's battery units contained a design flaw which caused them to overheat and cease operating.
The company claims CyberPower has refused to comply with the remedy provided under the original contract.
Arris is seeking more than $12.5 million in damages and is being represented by attorneys at Barnes & Thornburg LLP in Chicago.
