Sedgwick CMS sued over unpaid surgery bill

An insurance company is being sued for allegedly failing to pay a surgery bill.

Ambulatory SurgicalCare Facility LLC filed a lawsuit Dec. 10 in the Cook County Circuit Court against Sedgwick CMS and Daimler Trucks North America LLC, citing promissory estoppel.

According to the complaint, Sedgwick provided workers' compensation insurance to Daimler Trucks and on May 23, 2011, an employee filed for workers' comp benefits over a job injury.

Ambulatory SurgicalCare claims it provided services to the employee in connection with the work-related injury and billed Daimler by sending invoices, bills and communications to its insurance provider, Sedgwick.

The suit states that part of the employee's treatment required surgery, which was approved by the defendant on Nov. 17, 2011 and performed on Dec. 2, 2011. The plaintiff alleges the defendants failed to pay the $73,442 surgery bill.

Ambulatory SurgicalCare Facility is seeking damages in excess of $50,000 and is being represented by attorneys Eugene E. Murphy Jr., John N. Hourihane Jr. and David Feller Hyde of Murphy & Hourihane LLC.
