Equity Lifestyle Properties sued for negligence after fall

A woman is suing over claims she fell after a bench collapsed.

Theresa Jean Ruddy filed a lawsuit Oct. 28 in the Cook County Circuit Court against Equity Lifestyle Properties Inc., citing negligence.

According to the complaint, Equity Lifestyle Properties, a corporation headquartered at Two North Riverside Plaza in Chicago, owns and operates a recreational vehicle community named Fun-N-Sun RV Resort in Texas.

Ruddy claims she was a permanent resident of Fun-N-Sun around May 2013 and paid an annual fee to the defendant for exclusive use and enjoyment of her home site and all common areas. While on the premises, the suit states she and a friend were sitting on a concrete slab bench when the bench cracked and disintegrated beneath them, causing Ruddy to fall violently and become injured.

Ruddy is seeking damages in excess of $50,000 and is being represented in the case by attorneys David F. Wentzel and Scott D. Blake of Wentzel Law Offices.
