An insurance company is seeking damages it paid out to an injured man from the driver who allegedly caused the crash.

Prospective Insurance Co., as subrogee of Melvin B. Abbott, filed a lawsuit Oct. 30 in the Cook County Circuit Court against Mark W. Crawford.

According to the complaint, Abbott, the insured, was a pedestrian crossing the street near 1350 Hickory Point Blvd. on Oct. 31, 2011, when he was struck by an oncoming vehicle driven by Crawford.

The insurance company claims Crawford operated his motor vehicle in a negligent manner, operating it at an excessive rate of speed and failing to yield right of way to the Abbott, among other claims.

As a result of the defendant's negligence, Abbott suffered injuries and Prospective was compelled to expend sums of money for treatment of his injuries.

Prospective is seeking a judgment in the amount of $104,009.29, plus interest and costs of the lawsuit. It is being represented in the case by attorneys from Matek & Mazar LLC.
