Driver hit with lawsuit over car-pedestrian collison

A man is suing over claims his relative sustained injuries after a car him in an alleyway.

Daniel Matiushenok, as independent administrator of the Estate of Oleg Matiushenok, filed a lawsuit March 31 in the Cook County Circuit Court against Marikan Van Cleave and Thomas Van Cleave, citing negligence.

According to the suit, Oleg suffered injuries on March 29, 2012, when he was hit by the defendants' car while standing in an alleyway near Highland Avenue in Wilmette.

Matiushenok claims the defendants failed to yield to a pedestrian, which resulted in their vehicle hitting Oleg.

Matiushenok is seeking damages in excess of $50,000 and court costs. He is being represented in the case by Chicago attorney David Nemeroff of Nemeroff Law Offices Ltd.
