New homeowners claim Dream Town Realty, others failed to disclose flooding issues

A Cook County couple is suing after discovering the home they purchased is allegedly prone to flooding.

Brian Heffley and Trina Heffley filed a lawsuit May 9 in the Cook County Circuit Court against Ahmed Abdelsam, Sherin Soliman, Dream Town Realty Inc. and Windy City Home Inspection Inc., citing violation of property disclosure rules, fraud, negligence, fraudulent concealment, breach of contract and breach of fiduciary duty.

According to the suit, the Heffleys entered into an agreement to purchase a property at on North Wayne Avenue in Chicago on April 16, 2013 and the defendants failed to disclose flooding issues in the basement of the property that affected the foundation, roof, ceilings, floors, plumbing system, heating, cooling and sewage systems.

The plaintiffs claim they have experienced substantial flooding since purchasing the home and the property continues to flood despite the installation of flooding prevention devices.

The Heffleys are seeking damages in excess of $50,000, attorney's fees and court costs. They are being represented by Chicago attorney Robert T. Metz of Law Offices of Vasili Economopoulos P.C.
