A Lincolnshire nursing home and a doctor are being sued for the allegedly wrongful death of a resident.

Dennis Molloy, as executor of the Estate of William Molloy, filed a lawsuit May 16 in the Cook County Circuit Court against The Wealshire Inc., doing business as Wealshire Skilled Nursing and Rehabilitation Center, and Dr. Charles Colodny, alleging wrongful death and violations of the Illinois Nursing Home Care Act.

Molloy claims William was a resident at Wealshire Skilled in January 2013, when he Colodny placed a nasal gastric tube in his bronchial tree rather than his stomach. This, Molloy alleges, caused the nutritional shake the defendant administered in the tube to cause William to aspirate and ultimately die on Jan. 17, 2013.

Molloy is seeking damages in excess of $50,000, attorney's fees and court costs. He is being represented by Chicago attorney Edward M. Rubin of Rubin Machado and Rosenblum Ltd.
