Elmwood Care owners, management company faces wrongful death suit over resident's stroke

A Cook County man is suing over claims his mother's death was caused by the negligence of a nursing home after she suffered a stroke.

Larry D. Holston, as special administrator of the Estate of Lillian Holston, filed a lawsuit May 14 in the Cook County Circuit Court against Elmwood Care Inc., S.I.R. Management Inc., Byran and Juliana Barrish, Celeste and Michael Giannini and Gale Rothner.

The suit also names Drs. Brahma Gupta, David Bawden and Sivashankar Sivaraman as named respondents-in-discovery.

According to the complaint, Lillian was a resident Elmwood Care, a nursing home managed by S.I.R. Management and owned by the individually named defendants, on Aug. 15, when her daughters found her unresponsive in a wheelchair in the dining area, wearing only a shirt.

The plaintiff claims when Lillian's daughters expressed concern over the situation, they were ignored by Elmwood staff. The suit states it was not until the following day that Lillian was transferred to Mount Sinai Hospital, where she was diagnosed as having suffered a stroke long before her presentation at the hospital.

According to the complaint, which alleges wrongful death and violations of the Illinois Nursing Home Care Act, Lillian died Aug. 24 as a result of the stroke and neglect.

Holston is seeking more than $50,000 in damages and is being represented in the case by attorney Jeanine L. Stevens.
