Dispute over leasing contract leads to lawsuit

A company is suing over claims a financial group and others intentionally breached their leasing contract.

Your Doc S.C. and Hasan Merchant filed a lawsuit May 23 in the Cook County Circuit Court against Capterra Financial Group Inc., Nexcore Management Inc., Nexcore Properties LLC, Nexcore Healthcare Capital Corp., VTR Eberle Mob LLC, Peter K. Kloepfer, Gregory C. Venn and Robert Edward Lawless.

According to the complaint, the defendants entered into a contract with Your Doc S.C. to sublet Eberle Medical Office Building in Elk Grove Village, but have failed to do so in an attempt to maximize damages for the lease term through 2017.

The plaintiffs claim the contract allows Your Doc to supply a replacement tenant, but the defendants have failed to cooperate.

The suit accuses the defendants of artificially inflating and falsifying claims for rent by intentional failing and suppressing the plaintiffs' efforts to sublet the property, as well as breach of contract, tortious interference with contract and unjust enrichment.

The plaintiffs are seeking damages, attorney's fees and a decree that requires the defendants to abide by the subletting provisions in the contract.They are being represented in the case by attorney Paul Caghan.
