Man claims he fell into uncovered crawlspace while removing asbestos in Chicago apartment

An employee of an asbestos removal company is suing over claims he was injured when he fell into an uncovered crawlspace on the job.

William Lynch filed a lawsuit May 12 in the Cook County Circuit Court against Preservation Housing Management LLC, Grove Park Association, Poah Grove Parc Apartments LLC, The Grove Parc Tenants' Association, Heneghan Wrecking & Excavating Co. Inc., Bruce Finkelman, Empty Bottle Inc., Chicago Title Land Trust Company Trust No. 97185 and K-Plus Environmental LLC, citing premises liability.

According to the complaint, Lynch was working for Universal Asbestos Removal Inc. --which had been subcontracted by Heneghan Wrecking & Excavating, a contractor of Preservation Housing Management-- to repair a first-floor apartment on South Cottage Grove Avenue in Chicago.

Lynch claims he was performing asbestos removal in the unit on May 18, 2012, when he fell into an uncovered crawlspace and sustained injuries. The suit accuses the defendants of  failing to maintain the premises by covering the crawlspace or warning invitees to the premises of the danger.

Lynch is seeking more than $50,000 in damages and is being represented in the case by attorney Lawrence P. Maya of Deer, Stone & Maya P.C.
