ComEd seeks $131K from excavation company over cable damage

A utility company is suing over claims its cables were damaged as a result of careless excavation.

Commonwealth Edison Co. filed a lawsuit June 6 in the Cook County Circuit Court against Elgin Augering Inc., alleging negligence and strict liability.

According to the suit, ComEd informed the defendant of the location of certain underground utility facilities it maintained, operated and controlled near 1111 W. Cermak Road in Chicago.

ComEd claims Elgin Augering disregarded its warnings and damaged the underground utility facilities with an auger while engaging in a non-emergency excavation on Nov. 20, 2012, causing property damages in the amount of $131,399.58.

ComEd is seeking that amount, as well as court costs, and is being represented in the case by Oakbrook Terrace attorney Harry Dubnick.
