The family of a Cook County man who suffered a stroke is suing over claims the negligence of a hospital laboratory led to his death.

Patricia Was, as independent administrator of the Estate of Walter S. Was, filed a lawsuit May 23 in the Cook County Circuit Court against Presence Health Care, doing business as Resurrection Health Care and Resurrection Medical Center. The suit names Drs. Stephen Bozek  and Aslam M. Khaja as respondents in discovery.

According to the complaint, Walter received negligent medical care from the defendant's staff and laboratory personnel between Sept. 7, 2012 and Oct. 2, 2012, during which time they chose to withhold tissue plasminogen activator treatment instead of administering it as ordered after relying on incorrect information from the lab.

Was also claims they failed to timely treat Walter and provided physicians with inaccurate lab values. As a result of the alleged negligence, Was alleges Walter suffered progressive embolic stroke, brain injury and died.

Was is seeking more than $50,000 in damages and is being represented in the case by attorney Kent M. Lucaccioni of Kent M. Lucaccioni Ltd.
