A man who claims he was ejected from a vehicle is suing the dealer the car was purchased from, accusing it of selling a defective vehicle.
Michael D. Rende filed suit June 3 in Cook County Circuit Court against Carmax Inc., Deece Automotive and Mario Guagliardo.
According to the complaint, on May 4, 2013, Rende was a passenger in a vehicle operated by Guagliardo traveling in northbound on Interstate 65 through Remington, Ind. During the trip, Rende claims the front, right tire of the vehicle blew, causing the car to suddenly veer to the right and roll over three times.
Rende asserts he was ejected from the vehicle and sustained severe and traumatic injuries. He further alleges Guagliardo's vehicle, originally purchased from Carmax and Deece Automotive in the Village of Hillside, was deemed defective and the cause of the accident.
The suit accuses the company defendants of breach of warranty, implied warranty and products liability and Guagliardo of personal injury.
Rende is seeking damages in excess of the jurisdictional minimum and is represented by attorney John R. Ostojic of Ostojic & Scudder LLC.
