An Aramark driver is suing over claims he was injured by a manhole cover on the premises of Bite Cafe.
Joshua Spearson filed a lawsuit July 15 in the Cook County Circuit Court against Bite Cafe, the City of Chicago, Metropolitan Water Reclamation District of Greater Chicago and First National Bank of Morton Grove, as trustee under the provisions of a 1997 trust agreement.
According to the complaint, Spearson was picking up soiled items for his employer, Aramark, from behind Bite Cafe on North Western Avenue in Ukrainian Village on July 18, 2013, when he stepped on a manhole cover that flipped up and caused him to fall.
Spearson sued the bank as the owner of the property Bite Cafe rents and Metropolitan Water Reclamation District and the city since they are allegedly responsible for the manhole covers.
He accuses the defendants of being negligent in the maintenance of the premises and manhole cover.
Spearson is seeking more than $30,000 in damages and is being represented by attorney Howard M. Zavell of Dickler, Kahn, Slowikowski & Zavell Ltd. in Arlington Heights.
