A man is suing over claims his lawyer failed to represent him properly when signing a confession of judgment on his behalf.
Patrick McLean filed a lawsuit July 28 in the Cook County Circuit Court against Robert Keith Naumann, individually, and Robert Keith Naumann P.C., alleging legal malpractice.
According to the complaint, as McLean's attorney in Elk Grove Village, Naumann signed a confession of judgment on May 20, 2013 concerning a complaint filed against McLean in the Cook County Circuit Court.
McLean claims Naumann signed the confession of judgment without consulting him. He alleges it had erroneous statements, was prepared by the opponent's attorney and went against his best interests.
Naumann is accused of breach of fiduciary duties, breach of constructive contract, professional negligence and willful, wanton or reckless misconduct.
McLean is seeking more than $100,000 in damages and is being represented by attorneys Bruce N. Tinkoff and Timothy J. Murray of Tinkoff, Popko & Associates in Barrington.
