A Chicago lawyer is facing accusations he failed to file a client's lawsuit against a fast food chain before the statute of limitations expired.

Johnny Barginear filed a legal malpractice lawsuit July 30 in the Cook County Circuit Court against John J. Budin and Budin Law Offices Ltd.

According to the complaint, Barginear hired the defendants to recover damages for a personal injury he sustained on a wet floor at a McDonald's on Oct. 16, 2011, but did not file a lawsuit before the statute of limitations ran out on Oct. 16, 2013.

Barginear accuses the defendants of failing to properly file his suit in a timely manner and then failing to inform him when the mistake was realized.

He is seeking more than $50,000 in damages he claims he would have been able to recover had the defendants filed his lawsuit. He is being represented in the case by Jeffrey S. Deutschman of Deutschman & Associates in Chicago.
