Property owners' failure to disclose water damage leads to lawsuit against lawyer, law firm

A local law firm and lawyer are facing a lawsuit from a woman who claims they negligently advised them in a real estate matter.

Beata Grzesik and Mom The Builder Inc. filed a complaint Nov. 19 in Cook County Circuit Court against Beata Valente and Dynia & Associates.

According to the complaint, the plaintiffs retained the defendants on July 20, 2012 to represent them in the acquisition and sale of a property on Berkshire Avenue in Lombard. Valente, on Oct. 4, 2012, presented a residential real property disclosure report to Grzesik and advised her to execute it for the sale of the aforementioned property, but allegedly told her not to disclose instances of water damage to the sellers.

On Nov. 3, 2012, the suit states, the property was transferred to the buyers, who filed suit against Grzesik on Aug. 22, 2013 over the alleged inaccuracies on the disclosure report.

Grzesik is seeking damages in excess of $50,000, plus court costs, and is represented by attorney Daniel G. Suber of Daniel G. Suber & Associates in Chicago.
