A shopper filed suit against a grocery store for injuries sustained when he slipped and fell in 2014.

Francis P. Summerlin brought suit April 30 in Cook County Circuit Court against Fairplay Inc., doing business as Fairplay Finer Foods, of Chicago, claiming liability in the August 2014 incident.

Summerlin, a customer at the defendant’s 4640 S. Halsted St. store on or about Aug. 14, 2014, alleges he slipped and fell on a wet floor mat in an aisle containing refrigerated beer.

The suit states a faulty refrigeration unit leaked onto the floor, creating the hazardous condition. The plaintiff alleges the defendant was negligent in failing to manage, maintain, inspect and control the premises and the safety thereof; neglecting to remove the liquid, or repair the refrigeration unit adjacent to the floor mat; affix the mat to the floor to avoid slipping; use an industrial strength mat; and warn the public.

Citing internal and external injuries; nervous shock, pain, discomfort and impairment; loss of a normal life, medical bills, and lost earning capacity, the plaintiff seeks damages of more than $30,000, plus attorney's fees and costs. He is represented in the case by Scott Spiegel, of The Law Office of Daniel E. Goodman in Chicago.

Cook County Circuit Court Case No.: 15-L-4490.
