A Cook County woman has sued an Arlington Heights restaurant, alleging negligence in a July 2013 slip-and-fall incident..

Trudi Elber filed suit June 1 in Cook County Circuit Court against Big Shot Piano Lounge & Restaurant, alleging premises negligence in a 2013 accident.

According to the complaint, on July 6, 2013, when Elber was a patron on the defendant’s premises in Arlington Heights, she slipped, lost her balance and fell on a wet restroom floor. The suit states Big Shot Piano Lounge knew or should have known of the floor’s condition, that it was in breach of ordinary care and negligent in its duty to provide a safe environment for its patrons.

The complaint says Big Shot failed to maintain its property in reasonably safe condition; violated property maintenance code and OSHA regulations; failed to properly clean its floors or warn Elber of the hazardous condition; improperly operated and inspected the women’s restroom; failed to instruct employees in maintenance; and allowed a liquid substance to remain on the floor to the detriment of customers.

The plaintiff cites severe and permanent internal and external injuries, especially to her left knee; continued pain and suffering; inability to tend to everyday affairs; and medical expenses.

Elber seeks actual damages of more than $50,000, attorney fees and costs. She is represented by attorney James Lynch, of Keating Law Offices in Chicago.
