Estate sues over allegedly neglectful care before man's death

A man's estate is suing over allegedly neglectful nursing home care just before the his death.

Zachary Hudson, as administrator of the estate of Freeman Avery, filed a complaint  June 29 in Cook County Circuit Court against Norridge Gardens LLC, doing business as Norridge Gardens; Presence RMC Physician Services, doing business as Presence resurrection Medical Center; Presence RHC Senior Services, doing business as Presence Ballard Nursing Center; and Presence Holy Family Medical Center, doing business as Holy Family Medical Center.

Freeman was admitted on June 28, 2013, to Norridge Gardens, at 7001 W. Cullom Ave., Norridge, for nursing care, the lawsuit states, knowing that he was at a high risk for changes in his blood sugar, dehydration and malnutrition. While there, the lawsuit states, he suffered these changes, which led to a deterioration of his condition.

Freeman died on Oct. 29, 2013.

The plaintiff, citing negligence and violations of the Nursing Home Care Act, the Survival Act and the Wrongful Death Act, seeks damages in excess of $950,000, plus costs.

The plaintiff is represented by Marc S. Weissman of the Law Offices of Steven J. Malman and Associates PC in Chicago.
