A Cook County woman filed suit against a Missouri-based shoe retailer claiming premises liability when she was hit by a pole at its Chicago location in 2013.
Beatrice Roman brought a complaint against Payless Shoesource Inc., doing business in Chicago, July 10 in Cook County Circuit Court, alleging injuries in the August 2013 incident.
According to the filing, Roman was a customer at the firm’s 13 N. State St. location on or about Aug. 23, 2013. The suit states that when she was sitting in a chair designated for customer use, she was struck in the head by an unsecured pole that fell from its location.
Court documents indicate that Roman sustained severe and permanent physical injuries from the event, experiencing pain and suffering, medical bills, and hindrance from attending to daily affairs.
The suit states that the defendant was in breach of its duty to exercise ordinary care in the safety of its property. The plaintiff alleges that the business located the pole unsafely on a wall near customers’ chairs, used the pole for store operations without securing it to prevent it from falling, and failed to warn patrons of the unsafe condition.
The plaintiff seeks damages in excess of $50,000 plus attorney’s fees and costs. She is represented in the case by Gregory Olmstead of The Deratany Firm in Chicago.
