Patient alleges attack at nursing home

An elderly woman is suing her former nursing home, alleging it allowed her to be physically attacked by another resident.

Carol Elkins filed a lawsuit July 10 in Cook County Circuit Court against the Atrium Health Care Center, alleging negligence.

According to the complaint, on July 10, 2013, Elkins was a resident of Atrium when she was "struck, bit, punched and hit" by another resident. The suit says Elkins sustained injuries, pain and suffering, loss of a normal life, disfigurement, disability and medical expenses.

The lawsuit states the defendant should have known Elkins was at risk for being harmed by others. The suit alleges Atrium Health Care Center allowed Elkins to be attacked and injured, and failed to provide her with necessary care and services, properly monitor her, report incidents of abuse, advise Elkins' family about "the nature and extent" of her injuries, develop a current care plan, provide proper care and inform her doctors.

Elkins seeks $50,000, plus legal costs. She is represented by attorneys Stephanie K. Nathanson and Michael T. Peterson of the Law Offices of Stephanie K. Nathanson in Chicago.
