Family alleges wrongful death in nursing home resident’s passing

The representative of a Cook County family is suing a nursing home, alleging wrongful death in the passing of an elderly resident.

Barbara Leve filed a lawsuit as special administrator of the estate of Viviana Turcot on July 13 against The Ponds of Wealshire and of Chicago in Cook County Circuit Court, alleging negligence, wrongful death and infringement of the Nursing Home Care Act.

According to the complaint, Turcot’s condition deteriorated while she resided at the facility in Lincolnshire, resulting in her death Dec. 21, 2014. The suit states Leve was appointed special administrator by Cook County Circuit Court in July 2015.

The lawsuit states the defendant carelessly and improperly failed to monitor the plaintiff, create an adequate care plan and protection plan to address her cognitive and physical needs, complete a comprehensive assessment, and provide adequate staff, supervision, care and services.

Leve seeks damages for Turcot’s estate of more than $50,000, plus attorney fees and costs. She is represented by attorney Theodore Gilbert of Botto Gilbert Lancaster in Crystal Lake.
