A Cook County man filed suit against a motorist claiming several counts of negligence in a 2013 pedestrian-automobile collision in a downtown Chicago crosswalk.
Christian Vasquez brought a complaint against Danuta Grochmal on July 13 in Cook County Circuit Court, alleging vehicular negligence in the October 2013 crosswalk accident.
According to the filing, Grochmal was operating a motor vehicle eastbound on Diversey Avenue at its junction with Narragansett Avenue in Chicago on Oct. 28, 2013. The suit states that Vasquez, who was a minor at that time, was lawfully crossing Diversey on foot inside the intersection crosswalk when the defendant’s vehicle collided with him.
Court documents indicate that Grochmal failed to keep a sufficient lookout, drove at a greater speed than appropriate for existing traffic conditions, failed to reduce her speed, slow down or stop to avoid hitting the pedestrian, drove with inadequate brakes, and neglected to yield the right of way or give audible warning of her approach.
Vasquez contends that he sustained injuries, medical expenses and limitation from attending to his usual pursuits and occupation for a period of time.
The plaintiff seeks damages of more than $50,000 plus attorney’s fees and costs. He is represented by Neal Gainsberg of Gainsberg Law in Chicago.
