Store sued over allegedly icy sidewalk created by gutter-less roof

CHICAGO -- A woman injured after slipping on an icy sidewalk outside a suburban store is suing the store's owners. 

Kristen Culotta filed a complaint on July 16 in Cook County Circuit Court against Pabcor Management LLC and Creators Way Bedroom and Sleep Shop of Arlington Heights Inc., doing business as Roomz 4 Kidz and Teenz, and as Cribz.

According to the lawsuit, on Jan. 29, 2014, sheets of accumulated ice were formed about the parking lot and front sidewalks of the defendant's store at 1302 N. Rand Road, Arlington Heights. 

Cullota, who was visiting the store, slipped on a patch of ice on a sidewalk, allegedly formed by runoff from the building, according to the suit. She fell and suffered injury, pain and suffering, and incurred medical expenses.

The defendants are cited with negligence and carelessness for failing to remove the defective roofing, remove the ice with salt, install a gutter system, warn the plaintiff about a potential danger, install warning signs, correct the hazard and maintain the sidewalk. The suit also cites them for creating the ice accumulations that wounded Cullota. 

The plaintiff, citing a count of negligence for each defendant, seeks damages of more than $100,000, plus interest and costs. 

The plaintiff is represented by Wayne C. Rollag of Bailey and Rollag in Chicago.
