Pedestrian hit by vehicle, sues owner, driver

CHICAGO -- A pedestrian who was hit by a passing motorist is suing the driver for failing to yield her the right of way and the owner of the vehicle for failing to entrust his vehicle to someone who drives more safely.

Anna Burge filed a complaint on July 9 in Cook County Circuit Court against Christina Lukach and Aaron Miller.

On July 18, 2013, Burge was walking near P.J. Keller Highway and Spencer Street in Lexington when Lukach, driving a vehicle owned by Miller on P.J. Keller Highway, collided with Burge in the crosswalk. According to the suit, Lukach didn't see Burge, who had the right of way.

Lukach is cited with carelessness and negligence for failing to operate the vehicle safely at a safe speed, give proper warning, keep a proper lookout, and yield the right of way. Miller is cited with entrusting the care of his automobile in the hands of someone who'd allegedly violate the aforementioned rules of the road and for not having adequate brakes on his vehicle. 

As a result, Burge suffered unspecified injuries, pain and suffering, loss of a normal life and medical expenses.

The plaintiff seeks damages of more than $100,000, plus costs.
