Contractor sues Niles after village strips sewer work bid, awards to rival who bid more

A contractor is suing the village of Niles, alleging his construction bid was less than the winning contractor's and that the plaintiff's company employs more minority workers.

DiMeo Brothers' Inc. filed a lawsuit July 23 in Cook County Circuit Court against the village of Niles.

According to the complaint, seven weeks after Niles awarded a construction contract to DiMeo Brothers' on May 26, the village rescinded the award in favor of another contractor whose bid was 15 percent larger and whose workforce had less minority participation.

The plaintiff seeks injunctive relief to keep the village of Niles from giving the contract for the Cleveland Corridor sewer improvement project to another contractor, the lawsuit states.

DiMeo Brothers seeks the original contract to be rejoined, for DiMeo Brothers' Inc. to perform the work in exchange for its original bid, which was allegedly $1,375,792 less than the bid awarded to Bolder Contractors Inc, plus court costs and attorney fees. The plaintiff is represented by attorneys Katherine A. Rehan and Douglas R. Johnson of The Law Office of Douglas R. Johnson in Chicago.
