The guardian of an elementary school child is suing the employing agency of a woman who the guardian alleges beat the child for dirtying his diaper, though the woman was found not guilty of criminal charges related to the incident.
Alyssa Negrete, as guardian of the child identified in the court file as G.N., filed a complaint July 22 in Cook County Circuit Court against Willemoore Inc., doing business as Health Force of Greater Chicago.
On Jan. 26, 2011, G.N. was 7 years old and a student at Lincoln Elementary School in Cicero. According to the lawsuit, an employee of the school, Stephanie Hartley, was assisting G.N. when Hartley allegedly "violently attacked G.N., forcefully hitting him about his body because he soiled his diaper."
G.N. allegedly suffered bruises, and pain and suffering. Hartley was arrested and charged with battery to a child, for which she was found not guilty of the charges, the lawsuit states.
The plaintiff, citing battery and negligent hiring, seeks damages of more than $100,000, plus costs.
