Woman dies after alleged transfusion with wrong blood type

An estate administrator is suing a Chicago hospital and staff members on claims of medical malpractice in a 2014 patient death.

Olessor Anthony filed a lawsuit against South Shore Hospital, Ruby Freeman, and additional unknown staffers in Cook County Circuit Court on July 23, alleging wrongful death in the January 2007 demise of Dorothy Foster following a blood transfusion.

According to the filing, Foster, who had type B blood, was given a transfusion of type A blood cells on Jan. 13, 2007. The suit states that hospital agents or employees were negligent by giving the patient the wrong type of blood, failing to proofread her information and adhere to proper procedure, provide communication between the blood bank and the nursing staff to prevent error, injury and death, provide safeguards to prevent clerical errors, and label blood samples accurately.

The lawsuit states that Foster died the same day, leaving two surviving adult children who have suffered pecuniary loss.

The plaintiff charges the defendants with medical professional negligence and brings the suit as a survival action, adding that the patient experienced conscious pain and suffering before her death.

Requesting judgment in excess of the minimum jurisdictional amount, attorneys’ fees and costs, the plaintiff is represented by The Law Offices of Rahsaan A. Gordon in Chicago.
