A cyclist is suing a cabdriver, his employer and his passenger after the passenger allegedly opened a taxi door directly into downtown Chicago traffic and struck the cyclist.
John Morrison filed a lawsuit Aug. 13 against Samuel Kwadwo Asare, Safe Taxi Co. and Kenneth D. Smith in Cook County Circuit Court, alleging negligence.
According to the complaint, on June 11, 2014, Morrison was operating his bicycle northbound on State Street near the 500 block when Asare, driving a taxicab owned by Safe Taxi Co., injured the plaintiff.
The suit says Asare was guilty of negligent control of his vehicle when he allowed Smith to open his door away from curbside into traffic in violation of municipal code, and failed to exercise due care to avoid the collision.
The lawsuit states the plaintiff sustained internal and external injuries, pain and anguish, medical bills, and hindrance from attending to his usual duties and affairs.
Morrison seeks more than $50,000 plus attorney fees and costs. He is represented by attorney Brendan Kevenides of Freeman Kevenides Law Firm in Chicago.
