A Cook County woman is suing a social worker and the social worker’s employer in a dispute involving custody and care of her 78-year-old mother.

Marianne Giovenco, the daughter and court-appointed guardian of Rosemary Giovenco, filed suit Aug. 19 in Cook County Circuit Court against social worker Matthew Berauer and his employer, the Kenneth Young Center. Giovenco alleges that, based on a false claim of abuse, Berauer and the Young Center have prevented Rosemary from being discharged after a hospital stay for an infection.

According to the complaint, on Aug. 8, Rosemary was admitted to St. Alexius Hospital for swelling and redness of the hand and wrist. After treatment with antibiotics for an infection, the plaintiff was informed her mother was ready to be discharged on Aug. 12. However, on that date Berauer told the plaintiff he was cancelling Rosemary’s discharge based on a claim of abuse he had received.

Representing the plaintiff in this case is attorney John J. Pappas Sr. of the Chicago firm of Pappas & Healy LLC. The plaintiff is seeking the return of her mother to her custody, an injunction and restraining order against Berauer and the Young Center, and court costs.

Cook County Circuit Court case number 2015-CH-12484.
