A Cook County couple is suing an Illinois travel stop business, alleging premises liability following a fall at an Indiana facility.

William Lee and Ella Sue Lee filed a lawsuit Aug. 31 in Cook County Circuit Court against Love’s Travel Stops & Country Stores Inc., alleging negligence in the 2014 incident.

According to the complaint, on Feb. 7, 2014, the Lees were on the defendant’s property, 3150 Grant St. in Gary, Ind., where an accumulation of snow and/or ice near the business’ gasoline pumps caused William Lee to slip and fall, sustaining severe and permanent injuries.

The lawsuit states Love’s Travel Stops & Country Stores was in breach of duty by failing to maintain its grounds in a passable and reasonably safe condition. The plaintiffs charge the defendant with improper operation, inspection and maintenance, along with failure to provide slip resistant surfaces, warn patrons of the hazardous ground conditions, and remedy the premises by removing the accumulated snow and/or ice.

William Lee alleges he endured suffering, pain, anguish, diminished capacity to enjoy everyday life, lost earnings and medical bills. His wife alleges of loss of consortium.

The Lees seek more than $50,000, plus attorney fees and costs. They are represented by attorney Daniel Flaherty of Flaherty Law in Plainfield.
