Union Pacific Railroad Co. sued over claims of negligence following hand brake incident

A locomotive engineer is suing Union Pacific Railroad Co. following injuries he allegedly sustained following a hand brake malfunction.

Alexander Perez filed a complaint Sept. 2 in Cook County Circuit Court against Union Pacific Railroad Co., alleging negligence.

The complaint states that on Sept. 24, 2012, while employed as an engineer for the defendant at its Proviso Yard in Northlake, Perez applied the hand brake on a certain locomotive, but the hand brake mechanism malfunctioned and gave way, causing Perez to sustain severe injury to his neck and other parts of his body.

The complaint alleges Union Pacific was negligent in its failure to provide a safe work place, and in its failure to inspect the hand brake and repair its defects, among other negligent acts or omissions.

Perez seeks damages of more than $50,000, plus costs of the suit.

He is represented by Richard A. Haydu of Hoey & Farina, PC in Chicago.
