Man sues tenant over claims of negligence following gunfire incident in ABC Cellular store

A landlord is suing his tenant over negligence claims following an incident where gunshots were fired in a certain Chicago cellphone store.

Mazen Diab filed a complaint Sept. 4 in Cook County Circuit Court against Fadi Inc., East End Inc., and Fadi Rafati, doing business as ABC Cellular, alleging negligence.

The complaint states that Diab leased property, located at 1719 1/2 E. 87th St. in Chicago, to Rafati for the purpose of conducting cellular telephone business there.

On Dec. 10, 2013, according to the complaint, Diab was inside the aforementioned store speaking to Rafati about rent when a masked person entered the store with a gun and demanded all inside to stay still.

The complaint then states that Rafati pulled out his own gun and began firing inside the store, negligently causing customers to panic and flee for safety and jeopardizing their lives by firing his own weapon.

Prior to this incident, according to the complaint, Rafati had made renovations to the premises, including building an elevated work area, for which he and East End Inc. had not obtained all the necessary building permits.

This elevated work area, the complaint states, had been negligently built at an improper height from its main level to the floor below.

All the above negligent acts combined to cause Diab to sustain injuries, pain, and suffering, and incur medical expenses.

Diab seeks a judgment of more than $100,000, plus costs of the suit. He is represented by Michael J. Marovich of Hiskes, Dillner ,O'Donnell, Marovich & Lapp, Ltd. in Orland Park.
