A Chicago worker seeks restitution for injuries allegedly suffered in fall on construction site

A Chicago worker is seeking restitution for injuries allegedly suffered in a fall while working on a residential construction site.

Roberto Tovar filed suit on Sept. 3 in Cook County Circuit Court, Law Division against Sumac Inc., also of Chicago, citing negligence.

According to the complaint, on Sept. 9, 2013, Sumac Inc. was the general contractor responsible for the general design and construction of the renovations being made to a particular residence in Chicago. On the same day, Sumac Inc. awarded a subcontract to Herdom Construction to work at the same residence.

Tovar was working as an employee of Herdom at that time, the complaint states, when he fell approximately 12 feet from a ladder propped up against said residence, and was hit in the face with an industrial nail gun, sustaining fractures to the lumbar vertebrae, skull and facial bones and requiring emergency surgery.

The plaintiff is thus suing for damages sustained in said fall, citing negligence, failure to report hazardous conditions and maintain a safe working environment, failure to maintain proper supervision of its workers, and other such damages. The plaintiff alleges severe and permanent physical injuries, significant pain and suffering, severe disability, lost time from work and inability to return to work as a laborer or carpenter, as well as medical expenses of the past and future.

The plaintiff seeks a sum of more than $50,000, plus court costs and attorney fees. The plaintiff is being represented by Edith Holland of Gottreich & Grace of Chicago.
