CSX subpoenas Discover Financial for testimony in wrongful death suit

A company named as a defendant in an alleged wrongful death lawsuit in Georgia is requesting a subpoena for documents allegedly relevant to its case from a Chicago firm.

CSX Transportation Inc., a defendant in the Georgia suit, filed a petition for a subpoena Oct. 5 in Cook County Circuit Court to compel Discover Financial Services to produce relevant testimony and material documents related to the Georgia case.

The original case stated faulty pavement around a railroad track caused a car crash that killed two Georgia College and State University freshmen, Alexander Delor and John Haruf Jr., on their way back to their dorm from Walmart. David Delor and John Haruf Sr., fathers of the deceased students, filed the original lawsuit naming CSX, the Georgia Department of Transportation, and C and H Paving Inc. as defendants.

CSX seeks a subpoena for the documents and oral testimony related to the case. It is represented by attorney Evan Lincoln Moscov of Chicago.
