A Cook County patient is suing a physician and affiliated healthcare centers, alleging malpractice in a pain management case.

Ryan Waesche filed a lawsuit Sept. 16 in Cook County Circuit Court against Dr. Timothy R. Lubenow, University Pain Centers (also known as Rush Pain Center Chicago), University Anesthesiologists, University Pain Physicians, Rush Surgicenter and Rush University Medical Center.

According to the complaint, on Sept. 9, 2013, Lubenow performed a spinal stimulator implant on Waesche to treat pain from right femoral neuropathy and right SI joint arthropathy at Rush Surgicenter. The suit says an error in surgery caused the plaintiff to subsequently contract bacterial meningitis.

As a result of the infection, the lawsuit alleges the plaintiff was rendered permanently disabled, deprived of a normal life and earning capacity, and is responsible for ongoing medical bills.

Waesche seeks damages of more than $50,000, plus court costs. He is represented by attorney Louis Hilfman of Hilfman & Head in Chicago.
